Article 1: Presentation of the Company
The Antika Officina Botanika company of Paolo Troiano, whose registered office is located at the address: Strada delle vigne, 54 - 65010 Collecorvino (PE) ITALY EU manages the website: (hereinafter referred to as "website ").
The company is registered in the Pescara Company Registry under the registration number REA 143825 (VAT number: IT01950520682).
The company is engaged in the production and sale of plant cultivation products (hereinafter referred to as "the Products" or "the Goods") over the internet.
These General Conditions of Sale (hereinafter « GSC ») define the conditions under which sales of products are carried out and services offered by Antika Officina Botanika di Paolo Troiano (hereinafter « The Company ») on (hereinafter referred to as the «Site»).
Each order placed by a customer, after having acknowledged these GCS, involves the formation of a distance selling contract which has as its consequence the irrevocable acceptance of the GCS by the Customer. Any person who has placed and paid for an order is considered a Customer, pursuant to the GCS. Anyone who does not correspond to this definition is not entitled to assert the GCS against Antika Officina Botanika di P.Troiano. It should therefore be understood that an order placed by a Customer on behalf of a third party is subject to the legal relationships defined in the GCS between the Customer and the Company, without the possibility of appeal by third parties against the latter.
These GCS are drawn up in Italian. Only the Italian version will be authentic between the Company and its Customers. The Company reserves the right to modify these GCS at any time and without notice. Any new modification to the GCS applies starting from its publication on the Site, for orders placed after its publication. If necessary, the GCS can be completed by specific particular conditions indicated on the Site.

Article 2: Products

2.1 – Description
The Products are the set of goods offered for sale by Antika Officina Botanika di P.Troiano on the Site.
The products offered by the company comply with the Italian legislation in force and the standards applied in Italy.
The company makes technical and practical information available to its Customers in each Product Sheet. These indications are communicated by the suppliers from whom the Company acquires the products.
The expiry date for perishable products and the duration of the warranty are also indicated on the product.

2.2 – Price of the Products
For each product, the relative price is indicated.
The sales prices indicated are prices including VAT and are displayed in Euros but do not include shipping costs. Shipping costs will be indicated on the Site, during the purchase process, before the final validation of the order.

2.3 – Product availability
In the event of unavailability of a Product due to the supplier running out of stock, the Customer will be informed via e-mail.
Depending on the availability of the Product, two different solutions may be offered to the Customer:
- A proposal for replacement with an identical or higher quality product, a proposal that the customer will have the opportunity to accept or refuse to request a refund. In the latter case and in the presence of several items in the order, the Company will assume the shipping costs if it deems it necessary.
- A refund of the price of the Product or service requested within fourteen days of receiving the email specifying the unavailability of the item. The total or partial refund of the order will be made within a maximum of fourteen days. This refund will be made through the same payment method used by the Customer at the time of purchase: via monetary refund of the sum via credit card, prepaid card or PayPal, via purchase voucher or in both ways. If a portion has been paid with a discount voucher, this will not be refunded.
Article 3: Orders

3.1 – Account creation
The Customer must create an account to obtain a login and password. This information is personal and cannot be disclosed, as it will give access to your personal information and order history. It is also possible to place the order with a simplified procedure, without creating an account, but simply indicating the place of delivery and making the payment in advance with a card or with a b/b.

3.2 – Order methods
The Customer places his order exclusively on the Site.

To confirm the choice, the Customer must click on "add to cart".
The customer can continue the order and return to the store by carrying out the same procedures, or click on "View cart" to complete the purchases.
If he is satisfied with the order, the Customer clicks on «NEXT» to move on to the second phase «Address».
During this phase the Customer chooses the shipping address and the billing address. You have the option to leave a message regarding your order.
Once you have made your choice, click on «NEXT» to move on to the third phase «Shipping costs».
During this phase the GSC will appear and the customer must select the "I have read the general conditions of sale and accept them without reservation" box to continue the order.
Also during the third phase, a new page entitled "Shipping costs" opens which allows the Customer to choose the shipping method and view the cost.
The customer must click on "CONFIRM" to move on to the fourth phase "Payment".

3.3 – Payment
During the fourth phase «Payment», the customer chooses the payment method.
Payment is made through a credit card or PayPal account. The cards accepted are: Visa, American Express, MasterCard and Maestro.
In compliance with regulations and to guarantee the security and confidentiality of customer information, Antika Officina Botanika di P.Troiano does not store bank details.
To guarantee the security of the payment information provided by the Customer, Antika Officina Botanika di P.Troiano has selected the Paypal payment platform.
To complete and validate the order, the Customer must click on "Buy now".
The order is final only after validation of payment.
Antika Officina Botanika di P.Troiano confirms in real time on its website that the payment has been received and that the order is therefore final.
An email will confirm the registration of the order. Failure by the Customer to comply with the obligations deriving from the GCS, and in particular with regard to any problem relating to the payment of the order, may cancel the order and suspend access to the services of Antika Officina Botanika di P.Troiano
Antika Officina Botanika di P.Troiano recommends the Customer to keep this information on a paper or electronic document.
The data recorded and stored by PrivateSportShop constitute proof of the nature, content and date of the order.
Antika Officina Botanika di P.Troiano undertakes to honor orders received on the Site only within the limits of stocks of available products.

3.4 – Modification of an order
For any request to modify an order, we invite you to contact Customer Service:

- Directly on our website by sending a request in the "Contact us" section.

Article 4: Shipping

4.1: General information
The products purchased on Antika Officina Botanika di P.Troiano are shipped to Italy
The products are shipped to the address indicated by the Customer at the time of the order.
The shipping time of the Products announced on the site corresponds to the order preparation time for shipping and does not include transport and delivery time, which depends on postal services.

4.2 – Delivery methods in Italy

Most shipments are delivered to Italy by BRT. Delivery takes place with the recipient's signature to the address indicated by the customer at the time of purchase. Some shipments can also be entrusted to specialized transport companies, depending on the size of the products or the destination chosen. In this case this information will be visible during the purchase phase.

Specialized transporter
The carrier will deliver the package to the address without obligation to deliver to the floor.
Taking into account the value and fragility of the goods, it is up to the Customer to check the items in the presence of the carrier.
Procedure to follow:
- The Customer must unpack the package and check its contents in the presence of the courier before signing the delivery note;
- If the products are damaged, the customer must refuse the package and note the damage noted on the courier's delivery note;
- Sign the delivery note only after having checked the goods;
- If the courier refuses to assist with unpacking, write on the delivery note: «Risk of damaged goods».
The Customer has 3 days after receipt to confirm the reservations by sending a registered letter to the courier.
If the delivery requires the use of a hoist, forklift or other means of support, the additional costs will be borne by the customer.
4.3 – Track the package
Customers can follow the status of their order on the Site, in the "My account / Orders" section.

4.4 – Delay in delivery
In case of delay in delivery, the Customer will have the possibility to contact Customer Service on the Antika Officina Botanika di P.Troiano website by sending an email via the contact form or to contact 085 8207099 from Monday to Friday from 10am to 18.
If the delivery is not made within the expected deadline, the Customer may ask the company Antika Officina Botanika of P.Troiano to make the delivery within a reasonable additional time. You may do so by registered letter with return receipt or in written form on a durable medium.
If this deadline is not respected, the Customer may terminate the contract by registered letter with return receipt, email or ordinary letter.
The contract will be considered terminated on the date on which Antika Officina Botanika di P.Troiano receives the letter of termination, unless it has been fulfilled in the meantime.
The sum paid by the Customer will be returned within fourteen days from the date of termination of the contract.
If it is necessary to open a case with the courier (non-normal delivery time, package not delivered...), the Customer must notify Antika Officina Botanika di P.Troiano as soon as possible, a maximum of 15 days from the expected delivery date of the package. After this deadline, no complaints can be accepted.
No refund can be made before the complaint process with the courier is closed. The processing of the case can last from 15 to 90 days depending on the destination and the delivery method chosen.

4.5 – Transfer of risks
The shipment is initially carried out by a carrier selected by Antika Officina Botanika of P.Troiano to the shipping address indicated by the Customer. In this case, any risk of loss or damage to the Products is transferred to the Customer when the latter or a third party designated by him (other than the transporter designated by Antika Officina Botanika di P.Troiano) physically takes possession of the Products.
If the Customer wishes to entrust the shipment of the Products to a carrier of his choice, other than those proposed by Antika Officina Botanika di P.Troiano, and if Antika Officina Botanika di P.Troiano expressly accepts this request, the risk of loss or damage to the Products will be transferred to the Customer upon delivery of the Products to the aforementioned carrier.

4.6 - Shipping costs

In the event of an unjustified return, rejected package or failure to collect the package by the buyer, the management costs of returning it to the sender will be considered to be borne by the buyer himself, as the purchase contract and responsibility for the goods is considered finalized. once the goods have left the seller's warehouse. In the aforementioned cases, shipping costs cannot be refunded. In case of incorrect entry of the shipping address of the goods, any additional costs to be borne by the courier after the goods have already been shipped are the responsibility of the customer.

Article 5: Return of goods

5.1 – Withdrawal
The Customer has 15 days from receipt of the order to inform Antika Officina Botanika di P.Troiano of his decision to withdraw.
The right of withdrawal is exercised when the Customer has received his order and wishes to return one, more or all of the items in his order within 15 days of receiving them. The Customer is not obliged to specify the reasons that lead him to exercise this right.

Receipt is considered to be the receipt of the package by the Customer or by a third party, in the place indicated at the time of the order: home, post office or business. At the end of the time specified above, the right of withdrawal lapses.

5.2 - Return methods
The customer must send, at his own expense, the product/products he intends to return to: Antika Officina Botanika di P.Troiano, in its headquarters in Italy. As part of the exercise of the right of withdrawal, shipping costs are exclusively at the expense of the Customer.
Antika Officina Botanika of P.Troiano recommends that the Customer use a "parcel tracking" service. In the event of a dispute, proof of shipping may be requested from the Customer.
The products must be returned intact, clean and complete (i.e. in perfect condition for resale, not modified or assembled in contradiction to the manufacturer's recommendations and not disassembled), equipped with a label, accompanied by any notices and accessories and by a legible copy of the invoice. When the product is used, disassembled, modified, assembled or customized, the right of withdrawal lapses.
Antika Officina Botanika di P.Troiano will refund the sums paid within fourteen days from the date on which it is informed of the Customer's decision to withdraw.
Antika Officina Botanika di P.Troiano may delay the refund until the goods have been recovered or until the Customer has provided proof of shipment of such goods.
Antika Officina Botanika di P.Troiano makes the refund using the same payment method chosen by the Customer for the initial transaction, unless the latter agrees to use a different payment method and to the extent that the refund does not generate expenses for the customer.
Antika Officina Botanika di P.Troiano will not be required to reimburse additional expenses.
Return and refund methods
In the event of non-conformity of the products, the Customer may return them to the Company by respecting the following procedure:
Communicate your intention to return:
- By email: in the «Return or replace items» section of the Site, indicate if the object is «Defective product - Non-compliant», enter your email address and indicate the products in question and the reason for the return. Or send your request to: specifying the order number.
- By telephone: customer service is open from Monday to Friday from 10:00 to 18:00 on 085 8207099.
How to Prepare the Package:
To return goods, please use a standard parcel or the original delivery packaging. Returned products must be complete (manuals, accessories, labeled, etc.) in their original packaging.
5.3 – Refund
Refunds will be made within 15 days of validation of the Customer's request by Antika Officina Botanika di P.Troiano. A full refund of the order will result in a full refund of the order, excluding shipping costs. A partial refund of the order will result in a refund of the affected items, with the exclusion of shipping costs, since the cost of shipping costs is intended for the total of the items.
Antika Officina Botanika di P.Troiano can defer the refund until they are recovered or until the Customer has provided proof of their shipment. The date of initiation of the procedure is considered to be the first date on which one of the aforementioned facts occurred.

Article 7: Data protection
Pursuant to current legislation, please note that the nominative data requested from the Customer are necessary for the processing of orders and in particular for issuing invoices.
This data may be communicated to any partners of Antika Officina Botanika di P.Troiano in charge of the execution, processing, management and payment of orders.
It is mandatory to provide the following elements:
- Surname,
- First name,
- Email address,
- Address,
Without the communication of these elements the Customer will not be able to place the order on the Site.

This data will be used by the Company:
-To inform Customers and Members of upcoming sales via email;
-For order processing;
-To communicate special offers;
-For any other commercial communication, if the Member has agreed to receive offers from partners.
In the event that the Member no longer wishes to receive these emails, he can at any time:
- change your sending preferences by accessing "My account / My personal information";
- or by clicking on the links provided and added to each email sent by the Company;

Article 8: Disputes - Mediation of consumer disputes
These GCS will be executed and interpreted in accordance with Italian law. In case of disputes, the Customer will first contact the Company to obtain an amicable solution.
Article 9: Other
If one of the terms of the GCS is considered illegal or unenforceable by a judicial decision, the other provisions remain in force.
The information provided on the Site is authentic between the parties. Elements such as date and time of receipt or issue, as well as the quality of the data received, will prevail by priority as contained in the Company's IT systems, unless there is written proof to the contrary by the Customer. The scope of the evidence of the information provided by the Company's computer systems is that which is given to an original, in the sense of a written document, signed by hand.

Article 6: Intellectual Property
The content of the Antika Officina Botanika di P.Troiano website (photos, texts, graphics etc...) is the property of the Antika Officina Botanika di P.Troiano company and its partners and is protected by Italian and international law relating to intellectual property.
Any total or partial reproduction of this content is strictly prohibited and may constitute a crime of counterfeiting.
Article 7: Pre-contractual information – Customer Agreement
The customer acknowledges having received communication, before placing his order, in a legible and comprehensible manner, of these General Conditions of Sale and all the information, including article L. 111-1, and in particular:
- The essential characteristics of the Product, taking into account the communication support used and the Product in question;
- The price of the Products and related expenses (Shipping Cost);
- Information relating to the identity of the seller, his postal, telephone and electronic contact details, and his activities, if they are not evident from the context;
- Information relating to legal and contractual guarantees and their methods of application;
- The characteristics of digital contents;
- The possibility of resorting to mediation in the event of a dispute;
- Information relating to the right of withdrawal (existence, conditions, delay, methods of exercising this right), return costs, methods of withdrawal and other important contractual conditions.
The fact that a natural person orders on the Site fully and entirely implies adhesion and agreement to the present General Conditions of Sale, as recognized by the Customer, who therefore renounces the use of any contradictory document, which it would be inapplicable against Antika Officina Botanika by Paolo Troiano
